Medicinal Cannabis Licensing Application

ELIGIBILITY CRITERIA

The minister can only grant the license:

  • for purely scientific purposes or demonstrations;
  • to those who demonstrate to the satisfaction of the minister that they are trafficking in wholesale of medicinal cannabis and who do not sell over the counter and do not keep an open shop, unless as established pharmacist;
  • to those who demonstrate to the satisfaction of the minister that they are preparing medicinal cannabis in bulk;
  • to those who demonstrate to the satisfaction of the minister that they manufacture medicinal cannabis in specified designated and precisely defined locations.
  • to those who prove that this serves the interest of public health or that of animal health;
  • to those who need it to cultivate medicinal cannabis based on an agreement with another person to whom a license has been granted, with a holder of a permit or license granted in another country to import medicinal cannabis in that country and to the extent that this is not in conflict with public health interests.
  • to those who grow plants of the genus Cannabis for scientific research into the medical application of hemp, hashish and hemp oil or for the production of medicines.

Applicants must submit the following documents together with the application form and other required documents:

STEPS IN THE APPLICATION PROCESS

Applications are evaluated in a two-tier process:

  1. Basic screening of application (screening of individuals involved, business model and planning and financial due diligence and other feasibility issues);
  2. Additional permits and licenses screening (e.g. Building and Construction permits, Nuisance License, Medicine Wholesale permit, etc.)
    1. Complete the Application Form from the Office of Medicinal Cannabis Curaçao 
    2. Gather all Supporting Documents as indicated in the application form: 
      In addition, the following documents must be submitted: 
  • A recent and original Chamber of Commerce excerpt;
  • A certified copy of Shareholder’s register or original excerpt shareholder register executed by the Managing Director;
  • Valid identification document of the Ultimate Beneficial Owner(s), directors, authorized signatories and shareholders;
  • A Proof of Good Conduct (Bewijs van Goed Gedrag) from the government of Curaçao for each executive position within the company;
  • A business license from the Ministry of Economic Development of Curaçao permitting the corporation to act on the island;
  • A director’s license for each managing director (the law does not limit the number of managing directors); in addition, managing directors need a residence and a working permit to work in Curaçao. This requirement applies to all expatriates. Expatriates with a Dutch passport do not need a working permit;
  • A declaration from the Tax Inspection of Curaçao proving that applicant does not have a significant tax liability;
  • A certified copy of a proof of fund.

For Cultivation License Applicants: 

  • A full-time labor contract with at least one (1) Master Cultivator (bachelor degree or higher formal education with proven experience.

For Manufacturing License Applicants: 

  • A full-time labor contract with at least one (1) Pharmacist, registered with in Curacao
  1. Submit your Application:
    All completed application forms and all supporting documents must be placed in a single sealed envelope and delivered to:

  1. Await Feedback from the OMCC:
    The Authority will review your application for completeness and will notify you of any additional information that may be required.

All applicants are required to pay a non-refundable Application fee (for each license) in accordance with the Opium Ordinance.

APPLICATION FEES

The fee for an application for a medicinal cannabis or cannabis research license is f. 1.000 for each application.

Payment is required upon receiving an invoice from the Ministry of Health, Environment and Nature. Note that the application fee is non-refundable.

Be aware of the following:

  • A license for Cultivation will require a separate license for Processing, for Selling (unless solely applied for scientific research), for Delivery, for Possession and for Usage of cultivation site assigned.
  • A license for Manufacturing will require a separate license for Selling, for Delivery, for Possession and Have Present and for Usage of Cultivation Site Assigned.
  • A license for Selling will require a separate license for Delivery and for Possession.
